Terms of Service

1. Introduction

Welcome to WeScale Uploader ("Service"), operated by WeScale ("Company," "we," "us," or "our"). WeScale Uploader is a web-based tool designed for print-on-demand (POD) store owners to import designs, generate product mockups, and publish products to e-commerce platforms.

By accessing or using the Service, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements and that you are authorized to act on behalf of any business entity under which you operate.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must register an account using a valid email address. We use a passwordless magic link authentication system — a one-time sign-in link is sent to your email each time you log in.

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the security of the email account used to access the Service.
  • All activity that occurs under your account.
  • Promptly notifying us at support@wescale.ai if you suspect unauthorized access.

3.3 Third-Party Platform Connections

The Service integrates with third-party platforms including Printify and Shopify. When you connect these platforms, you authorize us to:

  • Store your API tokens in encrypted form for the purpose of operating the Service on your behalf.
  • Access your Printify shops, products, and blueprint catalog.
  • Access your Shopify store's products, media, variants, delivery profiles, and metaobjects.
  • Create, update, publish, and delete products and media on these platforms as directed by you through the Service.

You are responsible for ensuring that your use of these third-party platforms complies with their respective terms of service.

4. Description of Service

WeScale Uploader provides the following capabilities:

4.1 Design Import

  • Import design files from Google Drive shared folders.
  • Upload design files directly from your device.
  • Supported formats include PNG, JPEG, SVG, TIFF, WebP, HEIC, AVIF, and GIF. Files are automatically converted to compatible formats during import.

4.2 Product Creation

  • Create print-on-demand products on Printify using imported designs with configurable blueprints, print providers, variants, and placements.
  • Save and reuse product presets for streamlined workflows.

4.3 Mockup Generation

  • Upload mockup template images (mockup packs) and configure design placements.
  • Generate composite mockup images by overlaying your designs onto mockup templates.
  • Download generated mockups individually or as ZIP archives.

4.4 Shopify Publishing

  • Publish Printify products to your connected Shopify store.
  • Upload and assign mockup images to Shopify product variants.
  • Configure delivery profiles, color swatches, and product title customizations.

4.5 Asset Management

  • Browse, search, filter, download, and delete your uploaded design assets.
  • View import history with detailed status tracking.

5. Intellectual Property

5.1 Your Content

You retain all ownership rights to the designs, images, and other content you upload to or create through the Service ("Your Content"). We do not claim any intellectual property rights over Your Content.

By uploading Your Content, you grant us a limited, non-exclusive, worldwide license to store, process, transform (e.g., format conversion, resizing, compression), and transmit Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or your account.

5.2 Representations and Warranties on Content

You represent and warrant that:

  • You own or have the necessary licenses, rights, and permissions to use and upload Your Content.
  • Your Content does not infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party.
  • Your Content does not violate any applicable laws or regulations.

5.3 Our Intellectual Property

The Service, including its software, design, features, and documentation, is owned by WeScale and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand elements.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Upload content that is illegal, infringing, defamatory, obscene, or harmful.
  • Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
  • Interfere with or disrupt the Service's infrastructure or security mechanisms.
  • Use the Service to send spam, phishing, or unsolicited communications.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Resell, sublicense, or provide access to the Service to third parties without our consent.
  • Circumvent any rate limits, usage restrictions, or security measures.
  • Use automated scripts, bots, or crawlers to access the Service except through our provided APIs.

7. Third-Party Services

7.1 Integrations

The Service integrates with third-party platforms including but not limited to Printify, Shopify, Google Drive, and Cloudflare. Your use of these platforms is governed by their respective terms of service and privacy policies. We are not responsible for the practices, availability, or content of third-party services.

7.2 API Token Handling

When you provide API tokens or authorize OAuth connections for third-party platforms, we encrypt and store these credentials using industry-standard encryption (AES-256). We never store plaintext API tokens. Tokens are decrypted only at the moment they are needed to perform an action you have requested.

7.3 Third-Party Availability

We do not guarantee the availability or performance of third-party services. If a third-party service experiences downtime, rate limiting, or API changes, portions of the Service may be temporarily unavailable or degraded.

8. Service Availability and Modifications

8.1 Availability

We strive to maintain the Service's availability but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as-is" and "as-available" basis.

8.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.

8.3 Beta Features

Certain features may be labeled as "Beta" or "Experimental." These features are provided for testing and feedback purposes and may be modified, restricted, or removed at any time without notice.

9. Data Retention and Account Deletion

9.1 Data Retention

We retain your data for as long as your account is active and as needed to provide the Service. Import history, asset records, and product data are retained indefinitely unless you delete them.

Temporary data (such as ZIP download files) is automatically deleted after 24 hours.

9.2 Account Deletion

You may permanently delete your account at any time through the Profile page. Account deletion will:

  • Remove all your design assets from our file storage.
  • Remove all your generated mockup files.
  • Destroy all encrypted API tokens and credentials.
  • Delete your profile data, import history, presets, and all associated records.
  • Remove your authentication identity from our system.

Account deletion is irreversible. Products already created on Printify or published to Shopify will not be affected by account deletion — those must be managed directly on those platforms.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • We are not liable for any loss, corruption, or unauthorized access to Your Content.
  • We are not liable for any issues arising from third-party platform integrations, including product listing errors, publishing failures, or API changes.
  • Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless WeScale, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service.
  • Your Content, including any intellectual property infringement claims.
  • Your violation of these Terms.
  • Your violation of any applicable laws or third-party rights.

12. Termination

12.1 By You

You may terminate your account at any time by deleting it through the Profile page, or by contacting us at support@wescale.ai.

12.2 By Us

We may suspend or terminate your account at any time if:

  • You violate these Terms.
  • Your use of the Service poses a security risk or legal liability.
  • We are required to do so by law.
  • We discontinue the Service.

Upon termination, your right to access the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict of law provisions.

13.2 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@wescale.ai and attempt to resolve the dispute informally for at least thirty (30) days.

13.3 Jurisdiction and Venue

If informal resolution is unsuccessful, any disputes shall be resolved exclusively in the state and federal courts located in the Commonwealth of Pennsylvania, and you consent to the personal jurisdiction of such courts. Each party waives the right to a jury trial to the extent permitted by law.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WeScale regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

15.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
